When divorce becomes inevitable, planning is key

For any of the multitude of reasons why a couple chooses to enter in to matrimony, one consistent theme is the feeling of optimism. The two are making vows and commitments to each other that are designed to endure a lifetime. This is true despite the commonly known fact that somewhere around 50 percent of all marriages in Tennessee and across the country end in divorce. Consequently, if a person’s marriage is showing signs of stress and irreparable damage, it is wise to first plan for a divorce before threatening to file rather than simply pulling the trigger.

One thing to keep in mind is that despite the relative ease of entering into marriage from a legal perspective, ending one requires making decisions that impact important legal matters. Division of assets and debts, child custody, child support and alimony are all issues that must be resolved in a manner agreeable to the court before a divorce can be finalized. This is one reason why divorce financial experts suggest a well-thought-out plan before entering the divorce arena.

The first step is to objectively consider the decision as free from emotion as possible. If it’s the right choice under all the circumstances, be certain to understand the basics of the applicable law. It’s wise to gather copies of all relevant paperwork and documentation and share with well-chosen legal counsel. Parents should avoid using the children as pawns and keep things as amicable as possible.
